These terms apply to quotations, trailer orders, custom manufacturing, rentals and services provided by NSM Investments3 (Pty) Ltd t/a Buffalo Trailers.
Terms of business
Working with Buffalo Trailers
Please read these terms together with any quotation, order confirmation, rental agreement or other terms specifically agreed for your transaction.
1. Business identity
Buffalo Trailers is a trading name of NSM Investments3 (Pty) Ltd. References in these terms to Buffalo Trailers, Buffalo, we, us or our mean NSM Investments3 (Pty) Ltd trading as Buffalo Trailers.
2. Quotations
Quotations are based on the information and requirements provided by the customer. A quotation does not constitute acceptance of an order until the customer accepts the quotation and any applicable order or payment requirements have been agreed. Prices, specifications and availability are subject to confirmation at the time an order is placed.
3. Customer requirements
Customers are responsible for providing accurate information about the intended use of a trailer, including the type and approximate mass of the load and relevant towing requirements. Where information is incomplete or uncertain, Buffalo Trailers may request further information before recommending or manufacturing a trailer.
4. Trailer specifications
Trailer specifications may differ according to model, application, load requirements and agreed configuration. Dimensions, GVM, axle configuration, braking system, tyres, coupling and other components applicable to an order will be confirmed as part of the agreed specification.
5. Custom builds
Custom trailers are developed according to the customer's agreed requirements and intended application. Manufacturing will be based on the specification accepted for the build. Changes requested after manufacturing has commenced may affect the price, completion time or feasibility of the build and must be agreed with Buffalo Trailers.
6. Orders and payment
Payment requirements for trailer purchases, custom builds, repairs and other services will be communicated as part of the relevant quotation or order. An order may be subject to an agreed deposit or other payment arrangement before work begins. The customer remains responsible for amounts due in accordance with the accepted quotation or agreed arrangement.
7. Manufacturing and completion times
Any manufacturing or completion timeframe provided is an estimate unless expressly agreed otherwise. Lead times may be affected by the nature of the build, availability of components, customer-requested changes and circumstances reasonably outside Buffalo Trailers' control. Customers will be informed where a material delay becomes known.
8. Collection and delivery
Collection or delivery arrangements will be agreed with the customer. Customers collecting a trailer are responsible for ensuring that the towing vehicle, towbar and related towing equipment are suitable for the trailer being collected.
9. Rental reservations
Submitting a rental reservation through the website does not by itself guarantee availability or constitute a confirmed rental. Reservations remain pending until Buffalo Trailers confirms the booking. Rental rates are calculated according to the selected trailer and rental period shown during the reservation process.
10. Rental requirements
A customer renting a trailer must provide valid identification and proof of address when collecting the trailer. Additional information may be requested where reasonably required to process or verify the rental. Buffalo Trailers currently does not require a rental deposit for the rental trailers advertised on this website.
11. Rental payment
Customers may select the available payment method during the reservation process. Where EFT is selected, banking details will be communicated directly to the customer through an appropriate private communication channel. Banking details are not published through the rental booking form.
12. Rental use and responsibility
The person renting the trailer is responsible for using it appropriately and for ensuring that the towing vehicle and towing equipment are suitable for the trailer and intended load. A trailer must not be overloaded, used unlawfully or used in a manner inconsistent with its intended purpose or applicable road-safety requirements.
13. Rental return
Rental trailers must be returned in accordance with the agreed return date and time and in substantially the condition in which they were collected, allowing for reasonable use. Any extension to the agreed rental period should be arranged with Buffalo Trailers before the scheduled return.
14. Repairs and servicing
Repair and servicing work is undertaken according to the work agreed with the customer. If additional defects or work become apparent during inspection or repair, Buffalo Trailers may contact the customer before carrying out additional work that materially changes the agreed scope or price.
15. Product information and website content
We aim to keep product descriptions, specifications, photographs, prices and other website information accurate. Images may be illustrative of a trailer range or previous build, and individual trailers may differ according to specification. Customers should confirm important specifications before placing an order.
16. Safe and lawful use
Customers are responsible for operating and loading trailers safely and lawfully, observing applicable towing limits, load limits and road requirements. The towing vehicle must be appropriate for the trailer and load being towed.
17. Liability
Nothing in these terms is intended to exclude or restrict any right or remedy that cannot lawfully be excluded under applicable South African law. Subject to applicable law, Buffalo Trailers is not responsible for loss or damage resulting from misuse, overloading, unauthorised modification, unsuitable towing equipment, unlawful operation or use contrary to the agreed purpose or specification of a trailer.
18. Personal information
Personal information submitted through quotations, enquiries and rental reservations is handled in accordance with the Buffalo Trailers Privacy Policy and applicable South African law.
19. Changes to these terms
These terms may be updated as Buffalo Trailers' products, services and business processes develop. The version published on the website will be the current website version.
20. South African law
These terms and the provision of products and services by Buffalo Trailers are subject to applicable laws of the Republic of South Africa.
